America’s Judicial Dictatorship – Foreign Aliens Enjoy Special Rights To Enter U.S.
President Trump’s revised 90-day travel ban on 6 Muslim-majority has been blocked by some judges who still think the president’s executive order is discriminating Muslims, despite presented with justification and proof that 72 individuals from the seven countries covered in Trump’s initial executive order have been convicted in terror cases since the 9/11 attacks.
Based on information compiled by a Senate committee in 2016, the number of terrorists convicted from the seven countries included Somalia (20 terrorists), Yemen (19 terrorists), Iraq (19 terrorists), Syria (7 terrorists), Iran (4 terrorists), Libya (2 terrorists), Sudan (1 terrorist). This proves that the Ninth Circuit judges were wrong to say the 7 countries were innocent.
Of course, this time the pro-liberal judges can’t say there is no evidence showing a risk to the United States in allowing aliens from those seven terror-associated countries to come in. So, what did the judges do? They shift the goal-post. Not only the U.S. judges keep shifting goal-post, they also try to usurp the power of the U.S. president.
The liberalists say the latest blocking by two federal judges – one in Hawaii and one in Maryland – demonstrates the check and balance in a true democracy country. That’s true provided what the judges did is legal and constitutional. Under the Constitution and federal law, the president has the power to suspend immigration from any and all countries if he deems it in the best interest of the United States.
If President Trump has acted legally within his power, then it could only mean one thing – the left-wing judicial is launching a coup on the U.S. president. In his ruling in Hawaii, District Judge Derrick Watson has cited “questionable evidence” in the government’s argument that the ban was a matter of national security. This means, the judge is questioning the 2016’s findings of a U.S. Senate committee.
In the case between Imam Ismail Elshikh, an American citizen of Egyptian descent, against defendant President Donald Trump, Judge Derrick Watson (an Obama appointee) has ruled that the U.S. president cannot enforce his own executive order even if it was to protect the nation from migrants from terror-infected countries. The crazy story doesn’t end here.
Essentially, the judge strips President Trump of his executive power. Heck, he also prevents every other judge and every other state from following the President’s order. This also means a U.S. district judge is more powerful than the POTUS, making himself like a one-man Supreme Court substituting U.S. president and in the process reduces Trump as a pariah president.
In the lawsuit in Hawaii brought by Ismail Elshikh, an Imam of the Muslim Association of Hawaii, whose mother-in-law’s application for an immigrant visa was still being processed; Mr. Elshikh feared that his mother-in-law would ultimately be banned from entering the United State. In what appears to be an abuse of power, Derrick Watson rules in favour of Mr. Elshikh.
Astonishingly, the Hawaii District Judge held that American universities and immigrants living in U.S. can prohibit the Government of the United States of America from ever limiting immigration from Muslim-majority countries, claiming the First Amendment gives Muslim-dominant nations a right of immigration to America. Such ruling is ridiculous, of course.
The Supreme Court has repeatedly made clear that no foreigner has a right to enter the U.S. That’s why immigration and travel policies are there in the first place. While Imam Ismail Elshikh is an American, his mother-in-law is not. Therefore, his mother-in-law does not enjoy the special right of First Amendment to begin with and is subjected to vetting and checking.
If Judge Derrick Watson’s ruling is legal and constitutional, it also means that anyone and everyone from around the world – including terrorists – cannot be stopped from entering United States. Foreigners can simply scream “discrimination” against Buddhism, Hinduism, Sikhism, Judaism, Confucianism, Shintoism and whatnot to gain free access to America.
More importantly, there’s absolutely no precedent for the court’s order. In fact, every precedent is against the court’s order. Judge Derrick Watson’s ruling was so absurd and insulting that even liberalists such as George Washington University law professor Jonathan Turley and Harvard Law Professor Emeritus Alan Dershowitz think the ruling was a huge screw up.
The U.S. Supreme Court has also repeatedly held an alien seeking initial admission to the United States “requests a privilege, and has no constitutional rights regarding his application, for the power to admit or exclude aliens is a sovereign prerogative.” In fact, the actions of the President in respect of enforcing this law “are largely immune from judicial inquiry or interference.”
A district judge presides over his district, not the nation. District Judge Derrick Watson should not overrule other judges, nor dictate his opinions on the whole nation. He did both. This reason alone speaks volumes about his deliberate act of “second-guessing” the president on matters of national security and immigration. His hatred against Donald Trump is fantastically obvious.
Just as we have a right to decide which strangers enter our home and who sleeps next to our daughters’ bedroom or eats our family’s food, the POTUS is empowered to decide who enters the country. Perhaps District Judge Derrick Watson has forgotten that an admission into America is a privilege, not a right. The First Amendment does not apply to foreign aliens.
Instead of interprets the Constitution, a job that the Hawaii District Judge was supposed to perform; he told President Trump to fly kite, rewrote the law and appoints himself with an absolute power to control borders. He even granted Imam Ismail Elshikh a special right to bring whomever he liked or wanted into the country – all because Mr. Ismail is a Muslim.
